The car hire brokerage firm lodged the counter-claim last month after Avis Budget began legal action in January suing Affordable for $2.2 million.
In its counter-claim, Affordable alleged Avis Budget had deliberately tried to “decimate” its business, incorrectly issued invoices for 15,000 bookings over a 17-month period, “preyed on” its clients and increased rates without Affordable’s knowledge.
Affordable countered Avis Budget’s claims made against it and requested the case be heard by a jury.
County court documents filed in the US last week show Avis Budget has responded to Affordable’s counter-claim.
The document provides 65 "answers" to Affordable’s claims, many either denying the allegation in question or stating Avis Budget is “without knowledge or information sufficient to provide a response”.
It also lists nine "affirmative defenses".
The document concludes with a request that the judgement goes in Avis Budget’s favour, “and against Affordable Car, all at Affordable Car’s costs”.
It continues: “Plaintiff demands a trial by jury on all issues so triable”.
Affordable Car Hire chief executive Angela Day said: “For Affordable we are focused on business as normal while this matter is ongoing and continually thank the massive support of our agent community.”
